Terms of Use

What you are accepting
By creating an account on Kite Sessions you agree to these terms. If you disagree with any part, do not create the account. If you already created one, delete it in Profile › Delete account.
Kite Sessions is operated by RIZER TECNOLOGIA DA INFORMAÇÃO LTDA, registered under CNPJ 41.352.161/0001-21, and these terms are a contract between you and it.
To talk to us: [email protected].
What Kite Sessions is
A community app. It shows spots, lets you schedule a session (a meetup at a spot, with date and time), talk to whoever is going, report the condition you are seeing and list gear.
It is a meeting place, not a school, not a lifeguard and not a weather forecasting service. That distinction matters, and the "What we do not promise" section explains why.
Who can use it
You must be 13 or older. Between 13 and 17, you need the consent of whoever is responsible for you. One account per person, with truthful information: someone else's name, another person's photo or an account created to impersonate a third party are grounds for removal.
You are responsible for what happens in your account. Keep your password safe; if you suspect someone got into it, change it and tell us.
Rules of living together
The following is not allowed in the app:
- Offending, threatening, stalking or harassing anyone. This includes hate speech based on race, origin, gender, sexual orientation, religion or disability.
- Publishing sexual, violent or illegal content.
- Impersonating another person, school or brand.
- Spam, chain messages, advertising disguised as a report and links to scams.
- Making up a spot, a condition or a session. A condition report is information someone else will use to decide whether to get in the water, and lying there is different from lying on a social network.
- Listing what you do not have, what you cannot sell or what belongs to someone else.
- Scraping the app's content in bulk, attacking the service, trying to bypass limits or accessing data that is not yours.
- Using the app to recruit for another service without arranging it with us.
When someone crosses the line
Every screen with content from a person has Report and Block:
- Blocking takes effect immediately and does not depend on us. The person can no longer message you and their messages disappear from session chats for you. They are not notified. You undo it in Profile › Privacy › Blocked people.
- Reporting sends the case to our moderation, which reviews it within 24 business hours and may remove the content, suspend or close the account.
We close accounts without prior notice in case of risk to someone, fraud or a court order. In other cases, we notify and state the reason.
The content you publish
What you write, photograph and register remains yours. So the app can display it, you grant us a non-exclusive, worldwide, royalty-free licence to store, display and resize that content inside Kite Sessions and in promoting the app itself.
Royalty-free means no payment, in either direction. You do not pay us to publish and we do not pay you to display. By uploading a photo, a video or a text, you accept that there will be no charge, royalty or share for that display, neither now nor later. If you want to be paid for an image, do not publish it here: talk to us first, at [email protected].
Deleting is yours, and it is at any time
You can remove what you published whenever you want, including after moderation has approved it. In the spot gallery, tap your photo or video and use Remove; the file leaves the app and our storage. The licence above ends with it.
Three things survive that, and it is better to say so than to let you find out:
- Cached copy: the image may keep appearing for a few hours on devices and distribution servers that had already downloaded it.
- Backup: our backups are erased on a cycle, and the file may remain in them for up to 30 days. They are only opened to restore the service, never to republish what you took down.
- What was already published elsewhere: if the image went out in one of our social media posts, removing it in the app does not undo that post. Ask at [email protected] and we will remove it.
Deleting your account removes your content by the same rule.
You answer for what you upload
You warrant that you hold rights over what you publish. Material protected by someone else's copyright, a photo that is not yours and third parties' personal data do not belong here.
A person's likeness is a separate right. If someone appears prominently in your photo or video, you need that person's consent, and this holds even when the photo is entirely yours. Anyone appearing in an image published here can ask for its removal through the Report action on the screen itself or at [email protected], and we remove it.
The spots you register go through approval before becoming visible to everyone. Until then, only you and moderation see them. We credit whoever registered: your name appears on the spot.
The record of your acceptance
We keep the date you accepted these terms and the version of the text in force at the time, both at sign-up and for each file you upload. That is what makes it possible to know, later, which text was valid on that day, for you and for us.
User-submitted content
This section is the formal clause about what you upload. It coexists with the section above, written in plain language: that one explains, this one is the text that governs.
1. What it is. The User may submit to Kite Sessions texts, descriptions, reviews, comments, corrections, information about spots, photographs, videos and other materials ("User Content").
2. Licence. By submitting User Content, the User grants Kite Sessions, free of charge, a non-exclusive, worldwide licence, sublicensable to operational partners and valid for the term of copyright protection, for the following forms of use: (a) reproduction, storage and hosting; (b) editing, adaptation, summarising, correction, translation into other languages and combination with other content, including that of other users; (c) display, publication, distribution and communication to the public in the application, on the website, on social networks and in Kite Sessions promotional materials; and (d) inclusion in databases and compilations organised by Kite Sessions.
3. Survival. The licence remains valid even after the deletion of the User's account, specifically in relation to User Content already incorporated into spot information or combined with contributions from other users. The User may request the removal of photographs and videos of their authorship, which will be taken down within a reasonable period.
4. Authorship. The User remains the holder of copyright over the User Content. Moral rights are preserved under Law 9.610/1998. The User acknowledges that, as this is collaborative content, contributions may be displayed identified by username or in aggregate form, without individual attribution.
5. User warranties. The User declares that the User Content is of their authorship or that they have authorisation to submit it, and that it has not been copied from other websites, applications, guides or publications. The User is liable for any infringement of third-party rights arising from the User Content.
6. Moderation. Kite Sessions may review, edit, refuse or remove any User Content, at its discretion, especially content that violates these Terms, third-party rights or applicable law.
7. Factual information. Objective data about spots (location, wind direction, water type, facilities and so on) constitute information of common use and may be freely used, combined and updated by Kite Sessions and by the community.
Marketplace, rentals and schools
Sale listings, gear for rent and schools are registered by the people themselves. Kite Sessions is not a party to the deal: we do not handle payment, we do not hold the money, we do not deliver anything, we do not guarantee the condition of the gear and we are not responsible for what you agree between yourselves.
Meet in a safe place, see the gear before paying and be wary of anyone asking for a deposit up front. A scam in the app is grounds for closing the account and, where applicable, for reporting to the police.
Schools and professionals are responsible for their own licences, insurance and qualifications. We do not verify certification. The verified badge in the app means we confirmed that the business exists and is who it says it is, nothing beyond that.
Whoever registers a student answers for them
Schools and businesses run their operation through the panel, and in it they register students, lessons, waivers for signature and amounts receivable. That means storing data about other people on our servers, and whoever registers takes on three commitments:
- Having the right to register. The school answers for having the authorisation or the legal basis to process the student's data, and for having told them what it stores and why. We do not check that case by case.
- Registering only what is necessary, and keeping it correct. Weight is there to choose gear, email is there for the reminder and the waiver; no field exists to store what is not about the lesson.
- Serving whoever asks. A student who wants to access, correct or erase their own record asks the school, and the school resolves it through the panel. If it does not, the student talks to us and we mediate.
In that part, the school is the controller of the student's data and Kite Sessions is the processor: we store and process at its request. The Privacy Policy explains this from the side of the person registered, in the section "When a school registers you".
The waivers the school publishes for the student to sign are its own: the text, what it promises and its value are the responsibility of whoever wrote it. We store the signature with date, IP and the drawn stroke, and deliver that to both parties on request.
What we do not promise
This is the most important part of these terms, and it is not hidden at the end by accident. Read it.
Condition and forecast are not a guarantee. The forecast comes from a weather model and gets things wrong. The community report is the opinion of someone who was at the spot, with that person's eyes, clock and appetite for riding. The two appear separately in the app precisely because they are different things, and neither of them replaces you looking at the water.
Safety is yours. Kitesurfing is a risk sport. Wind, current, reef, rock, swimmers, cables and boats are not under our control, and the app does not measure them. A spot's hazard information is a contribution from the community, may be incomplete and may be wrong. Deciding to get in the water is always your decision, and the responsibility for it is yours.
We do not guarantee that anyone will be at the session. Marking attendance is an intention, not a contract. Someone who answered "I'm in" may not show up.
We do not guarantee the app will be up without interruption. We do what we can, but there will be maintenance, failure and error. The service is offered "as is".
Within the limits Brazilian law permits, we are not liable for damage arising from a decision of yours taken based on what you read in the app, from the conduct of another user, from a deal closed between you, or from unavailability of the service. The Brazilian Consumer Protection Code (Código de Defesa do Consumidor) remains in force where applicable, and nothing here removes a right it guarantees you.
Price
Kite Sessions is free. What is free today does not become charged retroactively: if a feature becomes paid, the price and the conditions appear before you subscribe, and whoever does not subscribe keeps the app working.
Kite Sessions Plus, the subscription
Kite Sessions Plus is optional and unlocks four things: requesting profile verification, talking in private messages, creating exclusive sessions and using the kite trip planner. Everything else, that is, spots, sessions, forecast, reports and marketplace, stays open to those who do not subscribe.
Plans and price
There are two plans, both with automatic renewal:
- Monthly, charged every month.
- Annual, charged once a year, for an amount equivalent to ten monthly payments.
The price that applies is the one the App Store shows at the time of purchase, in your account's currency and already including the taxes the store applies. It is the store that charges, and that is why we do not write a fixed number here: a figure in this text would diverge from the amount charged on the day the price changed.
How the charge works
- Payment is debited from your App Store account when you confirm the purchase.
- The subscription renews on its own for the same period, at the same price, unless you turn off automatic renewal at least 24 hours before the end of the current period.
- The renewal charge happens in the 24 hours preceding the end of the period.
- Changing plan, turning off renewal and cancelling are done in your App Store account settings, at any time. There is no way to do it through us: Apple requires the decision to be taken there, and the app takes you to that screen.
- Cancelling stops the next charges; the period already paid remains valid until the end. Refund requests go to Apple, through its support.
- We do not offer a free trial period. If one day we do, its length and what happens at the end of it will appear before you subscribe.
What the subscription does not buy
The verified badge is not for sale. Subscribing gives access to requesting verification; approval depends on review of the document submitted, and may be refused. No passage in this section promises the badge.
Nor do we buy for you what depends on third parties: a lesson is with the school, a rental is with whoever rents, and Plus does not interfere in either.
If the subscription ends
Access to the four paid features ends together with the period. Nothing you created is erased: the trips you planned, the conversations you had and the sessions you organised keep existing, and become accessible again if you subscribe once more.
Changes to these terms
We may change these terms. When the change is relevant, the date at the top changes and we tell you in the app at least 15 days in advance. Continuing to use it after that is accepting the new version; if you do not accept, delete your account.
Closing
You close whenever you want, in Profile › Delete account, without asking anyone and without justifying. What happens to your data is in the Privacy Policy.
Law and jurisdiction
These terms follow Brazilian law. The courts of your domicile are elected to resolve any dispute, as the Brazilian Consumer Protection Code ensures.
